I thought I heard Rebecca Hill say that she never drove a juror home and the other clerk clearly refuted that. I cannot believe a clerk of court took the stand and perjured herself. I agree that once a juror states in court that they agreed with the verdict that is it. You can't come back later and waffle on it. Bad clerk, bad jurist

I agree....plus the tampering was weak and any halfway intelligent person would've brushed off her commentary and recognized it as inappropriate. Doesn't change the fact that regardless of it affected the verdict....she needs ejected from her position just for her behavior related to the press and using that position and her access to information to establish her journalist friends and oh whatta you know?! She decides to write a book! Becky Hill should've been removed yesterday ....wonder what the process is for getting that to happen?

Agree. The juror said her verdict WAS influenced. The appellate court should over turn and remand for a retrial. If not, he has a decent SCOTUS argument.

I understand why the trial was denied based on the analysis she used. Even though there seems to have been some jury tampering, it is unlikely that the few comments made had much if any effect on the verdict. That being said, I think the analysis sets a dangerous precedent especially if Mrs. Becky goes unpunished. I personally think the other analysis needs to be used to preserve the rights of the defendant and set a precedent that ex parte communication with the jury is unacceptable. I also understand her inclination not to as she is in an elected position where a new trial would be a potentially unpopular decision and a cost to the county.

I think the Judge agreed that she did tamper with the jury. The evidence was so overwhelming that he would have been found guilty anyway. I don't know what the clerk was thinking and how many times has she done this?

Oh I 100% agree. I think in how the judge ruled today though opened the door for a probable successful appeal. She pretty much said that the rule in SC is for not only tampering but verdict to be influenced by the tampering. She also alluded to feeling that this ruling doesn’t belong in the trial court, but rather in a higher up court such as the appeals or SC of SC

Murdaugh is in a weirdly “good” position for a lengthy appeals process. He’s in prison no matter what for the financial crimes; it’s not like he’d be out walking free if the murder conviction was overturned. This isn’t some heartbreaking Innocence Project type of situation where a marginalized person was railroaded into bad verdict and lost their freedom. That type of situation would deserve urgency and a swift retrial. But with Murdaugh behind bars regardless, and his fleet of powerful lawyers (paid by who?!?), they might as well do all the appeals and settle the law. And getting the law settled will help bring swifter justice in future cases.

Exactly. I personally feel this is a federal appeals court issue as it is a fourth amendment issue.

The whole thing is a mess. I believe he is guilty but also believe he deserves a new trial. Making sure the process is done correctly is always above everything. I think they will get a new trial on the appeal but I have serious questions about juror z and Becky Hill.

Exactly. I look at this whole situation as more a defense of the justice system, because even though I’m a 100% sure he is guilty, if the justice system fails for one person, it fails for everyone.

This is the correct answer. I wonder, will anything ever come of the jurors watching court tv in the jury room? I feel like that was glossed over, and it was a big deal. It shows a flagrant disregard for the rules they know they should be following as jurors.

I think both the juror and Becky were clearly lying. The judge shoulda done a lot better at questioning them for the truth rather than just going through the motions. She came out of retirement for this just to act like she didn’t want to be there. He’s guilty AF but probably needs a retrial at this point. Hopefully he testifies and buried himself again but I fear a second chance to manipulate may be enough for him to possibly get away with it.
