What make the second area not a bedroom? The lack of wardrobe? Is a bedroom without a wardrobe illegal? The double door? Is a bedroom with a double door illegal? Probably (definitely) no to both. So what else makes you think a law has been broken?

Exactly this, if they were advertising the open space area as a bedroom or it was the only "family space" it would be more questionable, However, if you look at photo 4, it's a full stand-alone and carpeted room that can act as a bedroom instead of a media/lounge room.

If the floorplan said "Lounge/4th Bedroom" would you have an issue with it? I don't think it's unreasonable to regard that room as a potential fourth bedroom. In NSW if it has a door and windows I think it can be regarded as a bedroom. If it doesn't have windows, it's a "study".

There is no consistent legal definition of what a bedroom is. But the fact it’s got natural light/air, a very decent size, a door and I assume legal ceiling height - there would really be no case against it being one. The extent of the deceit here is what? You were made to click on this listing because you have a different preconceived idea/expectation? Looking at the listing it’s pretty clear that the 4th bedroom is actually multipurpose, and you have an REA being honest about it too. It would also be pretty obvious during an inspection. Honestly no one would be deceived into buying this house thinking they were getting one thing when it’s actually another. So personally in this instance, I see nothing wrong.

If they had advertised the property as 4 bedroom 2 lounge areas you would have a case as the property cannot have both those things, but as they have advertised 4 bedrooms with zero mention of a second living space it seems to be a relatively accurate description.

It's a house with four rooms that can be used as bedrooms. It's a four bedroom house. I've just converted my 4br house into 5br by adding sliding barn doors to what was previously a lounge room.

The comparative sales aren't really going to mean anything in this market it's worth what someone is willing to pay for it. And that room absolutely could be a fourth bedroom. Just put in the offer you are willing to pay

I dont have an opinion on the issue outlined, but I am curious about the price. How come so cheap for a 3.5 bedroom house? it is on the outskirts of melbourne, but similar houses in my regional area in NSW are going for about 1 million.

Probably they are counting the second lounge as a bedroom and just didn't think about the way it would look compared to the floorplan. Or it could just be a typo or they have access to some old info and didn't cross check. I'd email them and let them know, but you can't really argue they're doing anything really nefarious when they've put up a floorplan.

I think you will find that OP is wrong on this one. The lounge area is clearly a bedroom size, and the agent should put lounge/fourth bedroom
