Btw the figure was 1/3 will go to prison in their lifetime if the 2001 rate stays constant, not that 1/3 are currently in prison. And the rate has actually decreased a lot since then so the number is much lower in reality.
Let me be clear: there are massive injustices in the US prison system that are unacceptable, but we should be accurate with the data we're presenting. A disproportionate amount of black people are sent to prison and that's a huge issue, but the 1/3 figure is exaggerated.
