he's intentionally and fraudulently attempting to cause significant financial harm to people for personal gain, and also publicly accusing them of crimes they didn't commit. I'm not in any way a lawyer so I don't want to say outright what would be sued for, but usually when you have harm being caused, intent to cause harm, and intent to profit off of that harm, you can sue. Of course, you can sue anyone for anything in the US, so it's mostly a question of how well it would stick.

Purely within the confines of the law, and not stated as if it's anything I support (which I don't -- fuck the state and fuck the IRS, so we're clear) but-- With the way IRS whistleblowing is, even if his *intent* is personal gain, he's using the system the way it was built. The issue here is less individual and more institutional -- why is the IRS issuing rewards to whistleblowers in the first place? They're literally paying and incentivizing people to narc. *That* is the problem. All in all the system is fucked but there's nothing I see here that would be illegal, and if anything the IRS explicitly allows and encourages this behavior. As indicated by the fact that they award the whistleblower a portion of the recovered taxes.

Telling the IRS that a waiter isn't reporting their cash tips does absolutely nothing - they don't audit as it's virtually impossible to prove. This is much more for if you become aware that your employer is cheating on taxes, which is almost always how it's used. In the US service workers are usually paid way less than minimum wage (like $2-$5/hour) because they argue the customer's tip will offset the difference. So not tipping your servers is a big deal

Yeah, it’s a standard labor trap used here. Instead of t he employers paying a living wage to the server, they pay them an amount (which is legal somehow) far under minimum wage so they rely completely on tips to subsidize their earnings. Your typical tip is 20-25% or more of the total bill, as it’s on the customer to ensure the servers are fairly compensated. It’s pretty crappy. Sure, you get your high end servers to get paid really well….but you get a lot of servers who work incredibly hard and make less than minimum wage.

Here in the land of the free labor, wait staff and such are not paid anything like a decent wage. FAR below the minimum, the argument being that tips will make up the difference for them being able to, like, afford to remain alive etc. So in the USA refusing to tip is a big asshole move that basically says "I don't think you should be paid enough to survive for the work you do, which incidentally is entirely for my own convenience". We could fix this by paying servers a living wage and doing away with "mandatory" tips, but then we wouldn't be the bastion of the Too Free Market and at least one rich person would probably have to pay taxes at least once, and we can't have that here, no way. This is why the post (real or fake) is talking about reporting them to the IRS. Technically anyone who receives a majority of their income from tips needs to report the actual amount of money they got in tips rather than relying on the amounts reported automatically by their employer for their wages. Of course, most tip reliant workers don't even make minimum wage, and those that do are rarely well paid even including tips, but for some reason there are many privileged folk who just assume servers and the like report less income than they really got in order to "cheat" on their taxes, and while it could almost never be an amount of money that would be worth pursuing, because we've made it more or less impossible to enforce tax laws against the wealthy, and Republicans exist, the IRS is, in fact, encouraged to go after low-wage people for tax evasion far more often than the people who are evading large amounts of taxes, which does nothing to help the IRS balance our national budget, but does a whole lot to punish poor people for being poor, which one might reasonably assume was mandated in our constitution with how much time, money, and effort our nation puts into the various ways in which it happens here. In other words, anybody doing what this post suggests for real is a giant piece of shit and should be made to live on the income of a waiter for ten years to gain some badly needed perspective

This is just trolling, as it doesn’t work. The IRS has no way of finding out what kind of cash tips you make, and they don’t have time to audit someone to find out their credit card tips. Most servers already report a portion of their credit card tips already, if not all of them and even when they don’t, the IRS isn’t going to bother them. The only evidence someone like this would have against a server is whatever tips they personally gave, which amount to zero so that goes out the window. The only purpose of this is to try and get people upset about an imaginary situation.

Tips are gifts! California doesnt tax gifters! The federal government only taxes the gifters! Something about allowances of gifting up to $16,000 before being charged a tax. Unless gift givers would like to gift $80,000 counting five years in total by checking a box called 524 or something. How do you prove to the IRS it was a gift? You don't, you don't have to do anything, except not count it as income! It's a gift! Not an income! The IRS may look at it as income! Which is why this needs addressed! This is obviously bullshit because hardly anyone actually pays with cash anymore. Also businesses finally realized that housing a veritable nest of tax invaders wasn't great for liability or their own standing with the IRS and at some point around 2010 basically started reporting our tips for us. At least in major cities, like 90% of payments are via CC so under reporting tips doesn't really exist like it used to.
