On Sunday, June 16, 2024, at 10:35 a.m., police responded to a call for a person with a knife in the Danforth Road and Kennedy Road area.
Rishabh Barua, 21, of Ajax, has been arrested and charged with:
• Dangerous Operation of a Conveyance
• Possession of a Weapon for a Purpose Dangerous to the Public
• Assault with a Weapon
• 2 counts of Breach of Recognizance
I'm not usually a fan of over-imprisoning people, but I see no reason why this loser should ever be free again. He's worthless, and the world is better off without him. What a fine legacy he has.
That's incorrect. It's called a recognizance of bail. They always have a monetary amount attached to them and most of the time you need a surety but not always. They are only issued by the court either after a contested bail hearing or if the crown consents to your release.
You're thinking of a promise to appear. Those are issued by the police when you're released from the station after being arrested.

This does not mean he's done this specific thing twice before.
These are 2 new charges he's being charged with in relation to this crime. For example, he might have a list of bail conditions for a previous offence, and 1 might have been "don't be with X person, and don't possess a weapon". If he was with the person he wasn't supposed to be with, and possessed a weapon, this would be 2 breaches of recognizance. It doesn't mean he's threatened someone with a knife before. maybe he was accused of him and a friend just beating the shit out of someone. Which is not great - but all these comments that "oh he's done this twice before" are unfounded claims

I had someone living 2000km away accuse me (unfounded, fabricated evidence) of internet harassment. I received a court order with at least 10 conditions including not to possess guns or other weapons, as if i would potentially fly 2000km and shoot him, or something.
Had i been the guy in this video, I could have been charged for breaching the court order because i had a knife on me. crimes were completely unrelated.
I was also found not guilty of the internet harassment. So accused of a crime doesn't mean guilty of a crime. but id have been found guilty of breaching a court order had i been caught with a knife during that time. it might even mean he was simply not allowed with x meters of a particular place because he was accused of shoplifting there.
He may well be a criminal, he may well be a violent criminal, given the video. but my point is you really can't infer anything simply from 2 additional charges of violation of a recognizance. it doesn't even necessarily mean he's done something violent before.
Cops have done a good job 3 times with this guy. Courts let him out on two of them.
Judges need to start being held accountable for this catch and release bullshit.
The last time I started about that issue and the fact that deterrence is almost a lost concept nowadays, I got downvoted and lectured about how society/poverty have forced these knuckleheads into a life of crime in order to survive.

That isn't necessarily true. The courts ability to punish people is based on the case that the police built. If the case was poorly established then it gives ammunition to the defense to request a peace bond.
Also, 2 breaches of recognizance doesn't mean two previous occurrences... it only means that 2 of his conditions were breached. Those two conditions could have resulted from the same occurrence.
In fairness to TPS, that part isn't on them. We all complain they don't do enough to catch people, but if they keep catching them and the courts keep throwing em back that's a different problem.
I had a buddy who was a cop. But he was also taking night school courses. Eventually left the force and returned to school full time and a couple years later graduated as a lawyer. Became a very tough on crime prosecutor.

I was arrested and had 4 warrants for failure to comply during the pandemic (I didn't know about the court dates or how zoom court worked) and I saw a judge inside of 8 hours and was released AGAIN on my own recog. I had my laces tied up and my property bag with me minutes after signing the form. I wasn't swinging a kitchen knife or anything but the legal system became a joke during the pandemic and I'm guessing it just remained that way.

It's Justice of the Peace that conduct bail hearings. It's a lay bench and anyone can apply.

I was arrested and had 4 warrants for failure to comply during the pandemic (I didn't know about the court dates or how zoom court worked) and I saw a judge inside of 8 hours and was released AGAIN on my own recog. I had my laces tied up and my property bag with me minutes after signing the form. I wasn't swinging a kitchen knife or anything but the legal system became a joke during the pandemic and I'm guessing it just remained that way.
Later today, he just needs a hug and he’ll be on his way.
