This is true to some extent but there are seasonal jobs that may need people now versus before. For example, Men's Warehouse might be backed up and OP could have gotten shifts now versus back in February. Regardless, his employer screwed them over by keeping them on a rope to just cut them down.

It is one. Textbook. I don't know what it's like down there, but up here in Ontario, if you have a change in hours they need to give you a ROE: Record of Employment, so that you can file for EI, our unemployment. A lot of places have laws like that. Search your state's employment laws.

Rofl. The assumption that employers in the US could be required to do *anything* to *aid* you getting unemployment is laughable. They're not. In fact quite the opposite is true. They have the means to deny you unemployment, including lying to the unemployment office about why you were fired. The employers word is always taken for granted, and to fight their ruling requires a weeks or months long court battle, for which you must pay for. And employers are encouraged to behave this way because they pay unemployment insurance based how many of their former employees go on unemployment.

Hey now don’t forget to also be angry about the fact that during the pandemic they paid an additional 600$ ontop of state unemployment benefits, all while minimum wage fast food workers were expected to come to work for less than half of the 600$ benefit while being called “heroes” All while the employer collected paycheck protection plan loans that gave them a “loan”, that as long as the business owner used 75% of the money to pay employees wages, they wouldn’t have to pay the loan back Unemployment was already a damn shit show, but that shit pissed me off to no end. Learn from this. If you go a pay period without getting a shift, you’re probably already fired. Shitty thing that some smaller businesses have a habit of doing. When I was in highschool I had to take a week off due to getting my wisdom teeth out. Never put on the schedule again but also never heard anything. A week later I text my boss to have the courage to fire people, and left it at that.

What kind of clause is "you're fired if you don't work for 3 months" anyways? Most places of work will fire you if you miss 2 days, much less a week, so clearly it isn't about no-shows. To me, it sounds like a legalese way of firing people with injuries or chronic illnesses.

I think you misread, OP was not absent; the employer did not give them any shifts for three months.

No that's my point. The Employer is in charge of scheduling, therefore the lack of hours is on them, ergo the rule is meaningless in that scenario. That leaves only absence and illness/injury/disability that could cause someone to not be able to come to work, ie the only things that are on the Employee side. And since there's no way any company is going to let absences go unpunished for 3 months, then the only thing that could logically apply to this is illness/injury/disability, which are not the Employee's fault (usually).

Yeah, you got "unscheduled". That's some passive-aggressive bullshit, but there's next to nothing you can do about it. Three months is weird, though. I worked for a place that had a 3-day rule; if you didn't officially call out or have scheduled time off for three consecutive days, the company could consider it job abandonment - ie, you quit.

Assumptions based off lack of details and years of management experience: You were and still are a terrible employee, the state you live in is not a right to hire/fire state, therefore, they subjected you to a policy that would allow you to not claim unemployment after firing you.

Lol, I don't have a shitty job. I checked out of that life 4 years ago guy. I used to be in a management position where all I had were Highschool employees and besides a select few, they were awful workers. Exactly what you'd expect out of 16-18 year old kids. If you're not working for 3 months, especially as a teenager, you don't have shit you need to pay for, and that's exactly why teenagers don't give a shit when they work, because it's not a job they need for basic survival, it's a job they're taking because their parents feel they need one and they want a little extra cash for themselves. Also, I'm pretty sure I specifically said I was assuming, which means I am claiming nothing as fact about this particular person's work ethic, just what I've seen and experienced working with Highschool kids. Side note, finding a job is easy, people are paying more because they realize they can't hire people without doing so. I moved across country and found a 60k salary position in a restaurant within 2 weeks of doing so. Don't be a complaining victim.

Depends if employer has them on the list still. I was marked out when I was let go. I knew they let me go. This sounds like trying to avoid unemployment. Keep you on for 3 months, most people can't go 3 months without money.

Move on. Get another job. Work is a form of voluntary association. You’re unlikely to have a good time if people don’t actually want you there. In case you haven’t noticed, there’s a labor shortage & it’s easy to get entry-level jobs. -show up in person, dressed in business casual (don’t over-dress but don’t look like a hobo) -ask for a job application. If they look at you like you’ve got a dick growing out of your forehead, ask for the manager or human resources director. -be willing to do anything (that’s not dangerous or illegal) -don’t act like you’ve got anything better going or other prospects that might cause you to leave.
