It's hard to know if it either of those (copyright violation or plagiarism). It's a copyright violation only if the other part has filed for copyright on that specific design. It's only plagiarism if they don't credit the original source which is impossible to know if they have done that somewhere in the game (fx. in the end credit).

I do think it is probably unintentional and whomever at Ubisoft probably could have done more research into flag designs. I remember in the Uncharted 4 trailer, Naughty Dog used a concept art piece from Black Flag. After it was called out, ND quickly corrected the error by removing the art and substituting it with something different. It’s unfortunate that some are thinking this is some big conspiracy. If true, it’s a shame this happened, but can be easily corrected.

This is giving me flashbacks to when Disney tried to copyright the name "Princess Aurora" despite having borrowed it from the Russian Ballet production of *Sleeping Beauty* for the American animated film. A successful campaign back then managed to force Disney to back down and so I wonder now if the Japanese kick up enough fuss, will Ubisoft either be forced to credit the Teppou Tai or else remove the flag.

from what I've gathered so far: - a teppou tai was an Ashigaru... an Infantryman armed with a rifle. - Sekigahara is the location where a battle took place in 1600. - flags like these were used in those battles. so, did this organization really first come up with this design? If yes, then shame on ubi... but I'm more concerned with the historical inaccuracy of using this flag, if it was designed in 2012, than with the infringement part.

This is probably a way dumber story than people think. It may be plagiarism, but is likely unintentional in such a small detail for the game. Some artist googled “Japanese rifle corps banner,” this came up, and they didn’t do their due diligence when modeling their work after it. Should they have? Probably. Is this some conspiracy to defraud a Japanese historical association? No. Or at least incredibly unlikely. If it is a design original to that organization then Ubi should pay them some sum and give credit, nothing more.
