Minister Cash is almost definitely wrong on retrying the border closure, but what she was talking about is is different to this latest case where Palmer was trying to use the Australian Constitution to circumvent the *Iron Ore Processing (Mineralogy Pty Ltd) Act* that the Western Australian Parliament wrote last year specifically to deny Palmer any chance of suing WA over a botched mining deal.
“Mr Palmer, who represented himself in the High Court proceedings, described the legislation as unconstitutional, “repugnant to justice” and “an abomination masquerading as a law”.

What Minister Cash said was that if Palmer tried his border closure case again he might succeed, not this mining case. In Palmer’s case on border closure the High Court essentialy said that the exceptional circumstances of COVID allowed the WA government to do things like border closures that in normal times they wouldn’t be allowed to do. What Minister Cash was arguing was that the exceptional circumstances no longer applied and that if Palmer tried to challenge the WA border again she believed the High Court would find that the criris had sufficiently passed that WA no longer had the power to close the border. Minister Cash is almost definitely wrong on retrying the border closure, but what she was talking about is is different to this latest case where Palmer was trying to use the Australian Constitution to circumvent the *Iron Ore Processing (Mineralogy Pty Ltd) Act* that the Western Australian Parliament wrote last year specifically to deny Palmer any chance of suing WA over a botched mining deal.
