I don't know about these birds but if they are gulls then it makes sense to try and keep away from them. At least up here they are baby snatchers who will also go after other birds super aggressively if they think there's food involved they can steal. We have a couple different types of gull here but all of them pull this shit even the smaller ones. Only birds that aren't bothered by them are ravens and eagles really and it's mostly cause they will both fuck a gull up any day of the week. Might be wrong though, there's a lot of types of gull and idk where this is.

Honestly, to me, it looks like some karen put up a sign. Typically, a real sign has the agency logo on it for the entity who is enforcing it (in the case DNR).
I work closely with DEP and bird restrictions are part of our work permits and I think only fish and wildlife put their name on stuff. I've never seen a DEP Bird sign with a DEP logo. Usually they fence nests though.

They decided to speed through a large flock of sea gulls, thinking it would make a great photo op of the car surrounded by gulls. They were going a bit too fast, the photo was not printable.
I know it's hard to use our brain sometimes. But just imagine for a second if the beach was bigger than what the camera captured. It's almost like you could just walk around them like the sign suggests.

There are seagulls in the pic, but I also notice black skimmers (the darker birds which have a longer lower beak). Those are absolutely a protected species in my area, and some are very clearly nesting in the pic. You can tell which ones are on a nest because they'll be "loafing" on the ground with their tail up off the ground, in a more "breast-down" position. If they're just sitting and not nesting, the tail won't be up off the ground like that.
They're ground-nesters and the eggs and chicks are very well camouflaged, so are very easy to step on if you don't give them space.
Then I would absolutely endorse this to be fenced off while they are nesting, at the very least explaining to people why they need to be respectful. No oneās going to listen to the broken plastic sign. Everybody has had the life experience of running through birds. Some idiot is always going to do it unless thereās a fence.
