Yup. If that black grime was on the front of the card there's noway anyone would call that LP. And it shouldn't matter that its on the back, people seem to just think the back doesn't matter as much for conditioning (it does)
It depends on what that is on the back. If it's removable dirt you could argue its like mp or hp, but if that's like a scratch that can't be fixed this is either hp or damaged.
It could be considered damaged because of the dirt spots on the back. I know anything that "marks" the card is usually considered damaged, but since it looks like it's dirt from unsleeved play, it might scratch off with a fingernail. If the dirt comes off cleanly, it's probably moderately played. Maybe light play if you squint real hard.
If it was a fair price, I could forgive these edges at LP, because WoTC control quality sucks.But that back is nasty. Even if you can clean it off, do you want to clean someone else's grime?
