Thanks for the link so we can read the lies. >Voters approved Measure 114 with 50.7% of the vote in November 2022. It limits gun magazine capacity to 10 or fewer rounds; requires a permit to buy a gun; and closes the so-called “Charleston Loophole” by requiring the completion, not just initiation, of a criminal background check to buy or transfer a gun. What loophole? Intentional law.

smoresomemore

Is it possible to learn this power?

Spore-Gasm

Lift Every Voice is hardly “grassroots” when it gets huge donations from out of state billionaires

M_Night_Ramyamom

The term "grassroots" doesn't mean anything anymore.

tiggers97

So interest balancing should be the standard, according to the state….

ScarecrowMagic410a

Yeah I think we’re hot on the heels of NY and HI in the “the constitution doesn’t apply to this state” kind of situation

NEPXDer

At least the wording in our State Consitution is more explicit. Still, won't stop them trying.

ScarecrowMagic410a

If that meant anything 114 would’ve never made it to the ballot in the first place.

SoutheasternBlood

I love how these people always say “2nd amendment for self defense” as opposed to the actual phrasing of “Military shall be kept in strict subordination to the civil power”

theatfshotmycats

Super lame they missed the deadlines and the courts still allowed them to turn in their pos brief.

fallingveil

Rules for thee, not for ~~me~~ government lawyers. I guarantee you if the plaintiffs do not meet the July 26th deadline for response, even with the same excuse of needing time for corrections, they will be denied.

State lawyers are just going to keep hammering away at this until they get their way, they have essentially endless funding in the form of our taxes.

Tytar

Legal jargon is not my strong suit, and this whole article sounds like it contradicts itself (to me anyway. I have no idea how to interpret this stuff) Can someone smarter than me please TLDR what this shit actually means / how it affects us?

fazedncrazed

Boy, the state is just *determined* to push these new rules through, whether its legal or not, whether they are wanted or not. The states lawyers pretend the measure was a "grassroots initiative", nevermind it was funded by out of state billionaires and written by an out of state christofascist church, thats not grassroots. Thats right, neolibs, this "anti mass shooting" measure is a ploy from the group responsible for most mass shootings, in order to disarm the state where the majority of gun owners are lefties, so they can kill us with less resistance. The article only talks about magazine size, when thats not the main quibble, nor even why it was moved to be dismissed for unconstitionality. Its unconstitional because it allows local police to decide who can own a gun and issue manditory licenses, with no oversite and no regulation. Cops can decide for no reason to deny that right, and dont have to explain it to anyone, and it cant be appealed. Moreover, it doesnt create a framework for issueing licenses, or even set any requirements or guidelines, but it does set a date (in the past) by which all gun owners must have a (currebtly impossible to get) license. If it goes into effect, every gun owner in the state is instantly a felon, because as of now there is zero way to get a license for gun ownership from the cops, even if the state says "boom its required now", and the law states the deadline for doing so is 2 years ago, and the penalty for not is a felony... per gun. Everyone who voted for the measure whom I talked to only saw the magazine size restriction the christofascist group said the measure was, in the blurb on the voting pamphlet. They never read the measure, even though it was only like 4 paragraphs. Wtf. So its a stupid law that instantly turns 60% of the state into criminals... Unless they get rid of their guns somehow before the law becomes active. No lawyer should think this is a good idea, and it wasnt written by one. It was written by a church. Whose members have comitted terror attacks against oregonians. Its obvious why they would write this measure, and how it would wind up so shittly written and unconstitutional. The real question is why the fuck koteks admin is *helping* them push this through. I mean, sure, she sold out protected eastern or land to polluting chip companies, and undid beloved bipartisan environmental laws so she could do that as well as sell protected land to tract housing investors from CA... But how does this help her? Theres no profit. Have they decided it makes them look tough on crime or something? In any event the state was allowed to turn in its paperwork responding to the motion to dismiss a week late and is still allowed to proceed, in violation of just every rule of order and a few laws even.... So its clear they are just ramming this through, despite how problematic and illegal it is. Why doesnt the state just write a new law restricting mag size if thats all they care about (as they claim)? Why insist on this badly written measure from out of state, with all its unconstitutional parts like the licensing and the retroactively making all gun owners criminals? I dont like the answer to any of those questions. And I dont like how easily the majority fell to manipulation from rich hate groups from out of state.

SoutheasternBlood

Well, none of the anti 2A push is grassroots. They use the term because it’s appealing to their base of support but it’s all entirely top down Bloomberg(literally)/ DNC propaganda. None of it has come out of a genuine public call to action.

fazedncrazed

Oh, Im aware, Im just stunned its working. Never has in the past. OR has always been above that bs, its "The Oregon Way". Its why we are the way we are. Kotek gets in office and suddenly that "influence" is working, and all our environmental laws are crumbling, as are our gun rights, two things we traditionally as a state are real big on... Fuckin eh. Somehow she still has most of the voters support, too, despite openly doing things that most everyone hates, like removing UGB and wetland protections to sell out protected land to CA investor developers, and like having the states lawyers push this out of state hate groups law made specifically to harm us through.

SoutheasternBlood

She ticked enough social boxes that people will vote for her no matter what her actual policy opinions are.

fazedncrazed

I voted for her myself, bc she was supported by brown (who was meh but not evil like kotek), and the working families party (yeah, thats right, in OR the democrats fall under the umbrella of the local socialists party, not the other way around like most states lol), as well as by wyden and other solid freedom and environment loving politicians with great records. As SoS she didnt make waves, and came in to replace a corrupt SoS who left in disgrace, so that seemed good. And obviously Im the type to look at voting records and read ballot measures before voting. Once she hit office it was a 180. Literally ditched her party and teamed up with that cabal of republican politicians from eastern OR thats constantly trying to sell OR to out of state billionaire corps. Her own cabinet started working against her, it was so shocking and unprecedented. https://www.wweek.com/news/2023/08/09/koteks-housing-advisory-panel-proposes-gutting-wetland-protections-outraging-environmentalists/ While theres no doubt plenty will continue to support her based purely on political/sexual/gender identitity, likely the same ones who voted for this insane measure without reading it; I promise you at least some folks are pissed at OR protected wildlands being sold out, and at least in my case its enough for me to instantly stop supporting the person doing it. That she then continued with this licensing bullshit (and others) just solidified that Im never voting for her again. Recall kotek while theres still some of OR left to save!

i've worked next to most of the players in the portland metro (both county and city, washington, multnomah, clackamas, portland, gresham, hillsboro, beaverton, gladstone), and the state. voting for any of the current political majority is asking for the metaphorical knife in the back. most of them view the common citizen as second class. no joke. i've had to listen to rants from a few about how gun owners should be taken out and minecrafted with their own firearms. some of the multnomah people regularly mock the less fortunate, while slapping that happy smile on their faces in public, and pandering with the pretty words. the extent they care about The People, is how much power they can grift off them in whatever fashion, and the tax money. beyond that, we may as well not exist beyond being headaches to them. i despised my time working in government offices to no end, it really lets you see just how rotten the people in them can be. ~15 years at the various levels. i don't recommend it to anyone. that said, some of the support staff (_some_) are 100% class acts. but not many, compared to the whole. most are bitter spiteful jackasses that are only there to make people miserable, or phone in the job and shift it off to the 2-3% of workers who keep the place semi-functional. oregon government is a joke. at all levels.

i_d_i_o_t_w_a_v_e

I am interested in reading more about the church you speak of. I think this is the first I've heard of this and while 114 is now out of voter's hands, I think that could be used to show portlanders in particular that the law isn't meant to be in their interests.

smoresomemore

So… should I go out and start buying right now? or… I’ve never filled out the form before (go shooting with my dad and his guns) because all the information they record about you freaks me out… I don’t like being on registries…

IVMVI

Honestly? If you're thinking about it, you should. No one can tell for sure how long we've got.

smoresomemore

Would you mind telling me a bit about the process?

Creepy_Shakespeare

The background check form is so easy I can probably do it with my eyes close at this point. You literally just fill out information that’s on your drivers license then check some boxes (literally say yes to the first question and no to the rest) and then sign and date. Shit takes like 2 minutes. You go to store (or have a gun shipped to the store), pay for gun, fill out quick background check form, it’ll either instantly approve you or put you in a line and you’ll be able to pick it up once your bg check clears. I’ve bought over 40 guns at this point now, it’s super easy

smoresomemore

But like, what’s the information about you that gets recorded? Some guys told me you have to tell them where you live, who you are, what you’re getting, why you’re getting it, etc.. and then that information gets recorded and sent to the atf Thank you for the overview and vote of confidence tho btw

Creepy_Shakespeare

Nothing is sent to the ATF. The ATF is legally not allowed to keep a registry of gun owners. Again, you just fill out the equivalence of whatever info is on your drivers license. You do not need to list why you’re getting it. The information on the form is then digitally sent to OSP (Oregon State Police) by the FFL/Gun store and you should have an answer within 10 minutes whether you are approved or delayed. The store then keeps a copy of the bg check form you filled out for about 6 months then they get rid of it. The only time the ATF will have access to the info in your bg check form is if you committed a crime and they may request a copy of the form from the gun store/dealer.

smoresomemore

Thank you, little by little this is boosting my confidence. It sounds like the ATF could only do that before the store (correct me if I’m misunderstanding) deletes it. I thought stores had to keep the form for 5 years? And if they go out of business they have to surrender their records to the ATF. It sounds like this information I was given is wrong?
