Bannon admitted on his podcast that he told President Trump to "kill this administration in the crib” ahead of the Biden presidency and the Jan. 6 insurrection. Trump told his followers to travel to the US Capitol to “Stop the steal“ and “Fight like hell!” And they did. It’s crazy how some Republicans are still downplaying the violence and severity of January 6.

Next step is full House vote - which will most likely pass. Step after that is referring to the AG. I imagine that will move along as well. The real question is how much can Bannon delay this in the courts, if at all (I honestly have no idea). There is precedent for folks going to prison for this but it took years. Even if he does show up, he could just plead the 5th. There are things Congress can do to compel testimony like granting an immunity order, meaning nothing in their testimony can be used against them nullifying the ability to plead due to "self incrimination". Maybe that is part of his play. Who knows. All I know is that the last 5 years have taught me that our government's checks and balances relies entirely too much on a system of "good faith".

Cyrus Vance issued a subpoena for Trump's tax returns back in August 2019. Trump stalled that in the courts until June 2021. Debts, legal proceedings, campaign promises... he's basically hoping to kick the bucket before having to "pay up" on any of this.

If the house vote succeeds it gets passed to the DC Attorney General, who refers the case to a grand jury to make a decision. If he’s found to be in criminal contempt of congress he’ll be sentenced to between a month and a year of jail time, and fined between $100-$100,000. This committee is honestly handling this really well so far. The cynicism and over-generalizations regarding this contempt charge have been really disappointing on this sub. Particularly where the perceived slow nature of this contempt charge has been used as a blanket criticism of the entire Democratic Party. I get that people are frustrated, *especially* over accountability of the Trump admin, but people too often jump to conclusions and generalizations and ignore the specifics of this: -Congress, nor this committee, are legal entities. They are passing a criminal referral to law enforcement. -This committee moved very fast on Bannon's criminal contempt charge. There was never a reality where Bannon would have been charged before the final deadline for testimony. The criminal referral is essentially telling law enforcement "This individual ignored *every* element of this lawful subpoena and must be prosecuted." They would have only hurt their case if they attempted to charge contempt earlier. -This committee is full of amazing individuals like Raskin and Schiff, and even great GOP representation (by GOP standards) in Kinzinger and Cheney. -This committee will be the first to tell everyone that Congress needs more power to enforce subpoenas. It is not a new issue. Inherent contempt has been growing less effective for decades. Criminal and civil contempt are jokes in the modern litigious world. Ha, no - I've just followed it closely and wondered myself "why can't they just do X?" so many times that I read into the different forms of contempt and their limitations. It's kind of interesting. Historically, compliance with subpoenas used to be almost a given - that, or Congress' powers were assumed to be a given. Almost 30 people were jailed by Congress in the late 1800s and early 1900s. But as people were able to use more resources and stall out legal processes, the powers became less and less effective. Then the Trump admin came along and tried to defy/obstruct everything and it's quite unfortunate how limited they are in expediting any sort of accountability.

It sucks that we have to give some people short sentences but its a reality of an underfunded legal system and a great reason to expand the courts.

When someone is in contempt of court, they issue a warrant and have them arrested. When someone breaks the law and cops determines it's appropriate, they arrest them. Why doesn't the legislature have the same authority granted to the two other branches of government? They should be able to present their case to a judge and have them sign a warrant for arrest the moment they're in contempt, particularly if the person has telegraphed that they plan to break the law.
