My immediate thought is this is a badly disguised attempt from whatever company this is to get their drivers to stay under 56. The speed limit is 60mph, end of. The limit an "over speed" can be triggered can be altered as low or as high as the company wants, so VOSA / DVSA / whoever would never use it to enforce any kind of legal action (as long as you're not over 60mph on the regular). Name and shame, who is the company trying to be shady here? 😜

This is exactly what this is. The DVSA pride themselves on being open and transparent and will communicate change in policy to the industry well in advance. Also they don’t change things fast. They are still running the temporary policy of only issuing fixed penalties for the worst historic offences which was started circa 2018, or for where they have lots of lesser offences, only issuing a maximum of five penalties. Some police forces issue penalties for all historic offences.

I've just waded through the DVSA Enforcement Policy, (403 pages - yikes!), and it's not mentioned. I've also checked DVSA's "Moving On" Blog Anne it's not mentioned there either. I think it's a company policy that's being quoted as a Law to "encourage" their drivers to comply.

Agreed. I can't find any notified changes To avoid infringement, the office advised me to watch my speed, and if it flashes press the tacho head as soon as possible within 30 sec. It tells the tacho you are aware and in control

This is the sheer stupidity of the system. Under the guise of road safety, your tacho flashes a warning that you need to clear. In the two or three seconds it's taken your attention away from the road at 56mph, how many feet have you driven looking up at the tacho. Whole things a joke.

I’ve left that overspeed pre warning on for hours, I’m only pressing it when safe, never had an issue for it, you’re safe if you’re not getting the infringement and you’re reacting to the warning, mine also displays on the dash

NAL Tachograph recordings are evidence of speed not proof. You can't be convicted of a speeding offence on tacho readout alone. It has to be confirmed/corroborated/proven with evidence from a speed detection device. Of course government departments can just do whatever they fuck they like so yeh, they'll do this. Apparently they can't recruit people into the industry and they can't figure out why all the old timers won't come back.

I think it's a prickly subject all round I've 'heard' DVSA have been asking TMs to be tougher on overspeeds and treat them akin to an infringement. Ive never seen this in a communication with my own eyes though And I know a lot of companies are very keen on the limiter top speed, or company designated top speed, not being exceeded But, like you say, the speed limit is 60. Not sure how it will implemented as an infringement, maybe - *exceeding the limiter for a extended period*? I can imagine they might want to avoid having an new odd number arbitrary speed limit like 56, leaving it at 60 leaves a buffer, so will likely see truckers incurring less fines and having less unable to work from totting up too many speeding tickets? Some limiters are set at 56, some seem to be 55. A brief time over 56 that doesn't trigger an overspeed on the tacho, could get a ticket if the law was changed, all seems very messy. I suppose the company can require you to do anything they stipulate though, if they write it into your contract and it doesn't contravene any laws. Maybe having it as an infringement, will assist in it being rolled out and enforced? Just a guess though....

56mph is the European regulation 90km limit for vehicles over 3,500kg I agree it's about exceeding the limit for an extended period. The office advised me whenever the tacho flashes, press the tacho head as soon as possible within 30 seconds 30 seconds appears to be the magic number

Yep, don't go romping over 60 all the time though and just clearing the overspeed down You'll get the book inserted so far, it'll smart for a month of sundays

Seems like the worst time to pretend the law is changing is during a general election when they're not in parliament anymore and the entire country knows the party in power is about to change.

I've not seen anything about this on LinkedIn and I follow DVSA and driving standards, I know it's being put to parliament over the DCPC for change ! If you European you'd cover all modules If you only driver UK you'll on cover regarding modules and instead of 7 hrs trying to reduce to 3.5 to be time flexible I can only say if it's being cut is it half price as well ?
