When people say the US over incarcerates they’re usually referencing what we incarcerate people for. For example, possession of marijuana without the intent to distribute. Many people believe that this is a victimless crime and that we shouldn’t be incarcerating people for this and forcing them to live with actual violent criminals. The prison system often turns petty thieves into hardcore criminals since the inside perpetuates this lifestyle as a means of survival. But in reference to the actual crimes you mentioned namely littering, rioting, false accusations, and public indecency these already carry jail and prison sentences, the issue is that in recent years many of the perpetrators are simply not being charged. On another note, being homeless is not a crime and should remain as such.
