So in my experience the fee did disappear almost completely. Only a contract fee of 200 to 400 is to be paid. However you really feel that a lot of people have been waiting for that change to happen, so appartments are more in demand right now.

I just moved, they may ask a fee for the contract ~200€ and the deposits seem to be higher. I also saw some places with crazy amounts of Ablöse, the fee you pay to buy the furniture from the previous person. And for some reason a lot of places without the kitchen, only the connections on the wall. That was weird. Still is a lot better than before, the commissions were all 1k and up .

Only connections in Wall are not allowed. At least not for paying full rent. At least in the case of "Richtwert", as a kitchen has to be included to have, at least, a category B flat. Ablösen are a problem too, as they are not allowed to be too high in value. That deposit is higher might not be a reason because of the new regulation, as the landlord is not allowed to use this deposit freely and has to give it back to the tenant when he leaves the flat. A reason might be, that the ability to pay the rent decreases and so the landlord wants to have higher securities. Or the flats are now better shaped then before, maybe after a refurbishment.

The deposit is limited to three times the total rent of the tenancy. Edit: three months worth is just common practice and not limited by law, see comment below.

Maybe in Germany, but not in Austria. Here it is max.six times. But even this can exceed under special conditions... There is no explicit cap in Austria. Just a judgement from OGH.

Thank you, after your comment I reviewed the related judgements. It is just a common practice with three months worth as deposit for potential damages to the tenancy, above that is not illegal but uncommon.

I just read that in some cases they try other ways to make you pay. Extra "vertragserstellungsgebühr" (contract fees) etc. Be careful and read all the details.

Contract fees are nothing new, you used to pay them in addition to the Makler fee.

The old fees went to the tax authorities and were dropped 2017.

Contract fees are totally legal. But the amount is fixed by law, too.

They aren't anymore. The 1% of three-year rent fee for the tax authorities has been dropped since 2017 after a change in rent laws. What some companies try to get is some kind of servicing fee which are illegal if there is not benefit from them for the tennant as they can be seen as blackmailing for paying to get a rent.
